All Users of any of Young Peacebuilders (hereinafter “YP”) online Platform, tools or services must agree to the following terms and conditions. Young Peacebuilders Club (YPC) Members and their participants and all users of YP’s online tools or Platform are hereinafter collectively referred to as “Users”.
Terms and Conditions
All Young Peacebuilders online Platforms, tools, website, resources or services (herein collectively “Platform”) are owned and provided by Young Peacebuilders registered Non Profit Organization with a registered office at 13310 S West BayShore Dr, Suite B, Traverse City, MI 49684, United States
Access to and use of this Platform can be found by creating an account at youngpeacebulders.com. By using the Platform you agree to be legally bound by and comply with these terms of use, which shall take effect from your first use of the Platform. If these terms and conditions are not accepted in full, you are not authorized to use the Platform.
You will defend, indemnify and hold harmless Young Peacebuilders (YP), its Trustees, employees and agents, from any and all claims, liabilities, damages, losses, or expenses, including legal costs, arising out of or in connection with any breach by you of these terms and conditions.
The Platform is available for use by those over 18 only, or by those under 18 who have the consent of their parents or guardian. By accepting these terms and conditions, you agree that you are over 18 years old or that you have such consent, and that you will review these terms and conditions periodically.
Each user account must be used only by a single individual and that individual must use the same whenever they access the Platform. Group accounts or other sharing of accounts is not permitted.
Operating the Platform
YP works hard to make the Platform enjoyable and functional but we cannot promise that everything will always work. There might be problems with particular browsers or operating systems or there might just be a technical glitch. Whenever we become aware of problems that make the Platform difficult to use, we will work to fix them. If you become aware of an issue please contact us on [email protected].
For the purposes of this agreement, “Content” means online content and/or course material including, without limitation, eLearning text, video, graphics and audio, files and various interactive activities, published on the Platform, whether copyright of YP or a third party.
YP does not warrant that the functions contained in this Platform will be uninterrupted or error-free, that defects will be corrected, or that this Platform or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the Content.
No data transmission over the internet can be guaranteed to be 100% secure; therefore any information sent by e-mail or submitted through the Platform is at your own risk.
All Content provided by or through the Platform, is provided ‘as is’ without any representations or any form of warranty (whether made expressly or implied by law). All implied warranties, terms and conditions of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy, or otherwise, are excluded to the extent permitted by law.
Any third-party provider Content is provided ‘as is’ and to the extent permitted by law, neither the relevant third party provider nor YP make any representations or warranties, express or implied, of any kind concerning such Content.
To the extent permitted by law, YP will not be liable for any damages and direct, indirect or consequential losses, including, any damages arising from the use or loss of use of the Platform, or the loss of data or profits, whether in contract, negligence or other tortuous action, arising from or in connection with the use of the Platform or any Content provided by or through the Platform, whether suffered or incurred by a User or any third party.
The Platform and Content may contain links to other websites. These links are provided for your convenience and YP has no control over such websites, nor is it responsible for their content. YP’s Privacy Policy does not extend to any websites that can be accessed from the Platform. The inclusion of these links on the Platform does not imply endorsement of any material on those websites, nor any association with their operators, unless otherwise stated. YP cannot guarantee the security of these sites, the operation of the links or that they will be virus-free.
Your use of any third party websites is at your own risk and subject to their respective terms and conditions and privacy policies.
The Platform may not be used in part or in full for commercial purposes without prior license from YP and Dr Michael McGill.
You agree to use the Platform for lawful purposes only and in a way that does not infringe the rights of, nor restrict or inhibit anyone else’s use and enjoyment of the Platform.
Civil Behavior
All Users are expected to behave civilly and contributions off and online should be both relevant and tasteful. Users should not behave in a way that would break US law, or any other applicable laws, or that would cause harm of any kind to YP’s online platform or its users. YP takes no responsibility for Users’ contributions or those of any other user.
If YP provides bulletin boards, chat rooms, access to mailing lists or other message or communication facilities (hereinafter collectively “Forums”), the User agrees to use the Forums only to send and receive messages and materials that are proper and related to the particular Forum. By way of example and not as a limitation, the User agrees that when using a Forum, he or she shall not do any of the following:
Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful Material or information or any other content that advocates unsafe or illegal activities (e.g. drug abuse, bomb making) or features graphic or gratuitous violence;
Express any view that could be considered hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity);
Upload or attach files that contain software or other Material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns or controls the rights thereto or has received all consents therefor as may be required by law;
Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another’s computer;
Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;
Falsify the origin or source of software or other Material contained in a file that is uploaded;
Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another User of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.
Users acknowledge that all Forums and discussion groups are public and not private communications. Further, the User acknowledges that chats, postings, conferences, e-mails and other communications by other Users are not endorsed by YP, and that such communications shall not be considered to have been reviewed, screened or approved by YP.
YP reserves the right to remove, for any reason and without notice, any content of the Forums received from Users, including, without limitation, email and bulletin board postings.
Copyright
All material on the Platform is the copyright of YP or third parties. You may view the Content of this Platform on screen. You may not copy, reproduce, republish, download, post, broadcast, transmit or otherwise use YP Content in any way except for non-commercial, personal or educational use, and then only if you do not remove or modify any trademark, copyright, or other notice displayed as part of the Content. You also agree not to adapt, alter or create a derivative work from any of YP Content except for non-commercial, personal or educational use, and then only if you do not remove or modify any trademark, copyright, or other notice displayed as part of the Content. Any other use of YP Content requires the prior written permission of YP and Dr Michael McGill.
The names, images and logos identifying YP or any other third parties referred to on the Platform and their products and services may be subject to copyright, design rights or trade mark rights. These trademarks may not be reproduced without the consent of the relevant owners. Nothing contained in these terms shall be construed as conferring any license or right to use any trademark, design right or copyright of YP or any other third party. YP reserves all rights not expressly granted in accordance with these terms and conditions.
Information You Provide To Us
Where you are invited to submit any contribution to the Platform (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant YP a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in YP privacy policy. If you do not want to grant YP the rights set out above, please do not submit your contribution, or FIRST ensure YP acknowledges it understands and is able to implement your altered terms you submitted in writing to YP.
Contributions must be your own, they must be civil and tasteful. You agree that YP shall not be responsible for your or anyone else’s contributions to its Platform or any form of social media. Changes And Conflicts
YP reserves the right to change and amend these Terms and Conditions from time to time without notice, and the User hereby agrees that the new Terms and Conditions shall take precedence over the previous terms. YP shall have no obligation to take the needs of any User into consideration in connection therewith.
YP reserves the right to deny in its sole discretion any User access to the Platform or any portion thereof without notice.
No waiver by YP of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.
